Richmond County Surrogate Robert Gigante, found that a contract to sell real estate signed by the decedent before he died, which had not been legally challenged, was enforceable against the estate. This is of course is a matter of interpretation of the particular contract but most real estate contracts would probably be written to be enforceable in the event the seller dies pre-closing. The death of a purchaser would most likely be a basis to void most real estate contracts.
